What is a visa extension?

A SA visa extension is an application to renew your existing visa to extend your stay in South Africa. The visa extension is an entirely new application. Applicants must get the necessary paperwork to submit to VFS who collects the visa applications on behalf of the Department of Home Affairs. A submission for a visa renewal does not mean that you will automatically receive an extension as the Department of Home Affairs will decide to either approve or reject your visa.

Not all visas can be renewed or extended and in this particular scenario, the applicant must leave the country before their visa expires or you might receive a penalty for overstaying in South Africa on an expired visa.

The visas that may not be extended:

  • Corporate Workers Visa.
  • Tourists visas with a condition not being allowed to extend.

Depending on your visa and the conditions attached, you may or may not be allowed to extend it. Temporary residence visas, on the other hand, can be extended and no limit is applied to the number of times you can apply for a renewal.

Yes, you can extend your visa at VFS if you entered South Africa after the 14th of March 2021.

The Department of Home Affairs has decided to extend the validity of visas which has expired during the lockdown period to 30th September 2021. This means that any applicant who entered South Africa between December 2019 and 14th March 2021 are legally allowed to remain in the country until the end of September. These visa extensions apply to the following holders:

  • Visit visa holders.
  • Temporary residence holders.

Foreign nationals who are stranded in South Africa because of Covid-19 who would like to be repatriated to their country of residence are allowed to leave the country without being declared undesirable. Any foreigner who would like to remain until the end of September are welcome to do so and must strictly adhere to the regulations of their visa.

TRP visas issued for 90 days or up to three years are urged to renew their visas before the end of September.

Short-term visas:

  • Visit and business visas that have no visa conditions.

The tourist visa can either be extended for 30 or 90 days and the decision is completely up to home affairs officials to award you with the number of days they feel are due to you. The renewal must be applied for 60 days before the expiry of your current visa if you were granted a 90-day visa and 7 days before your expiry if you were awarded 30 days or less.

All long-term visas must be applied for 60 days before the current visa expires, although applicants must bear in mind that work visas must be prepared for way in advance. Some work visa processes can often delay the process and thus in your best interest to start the process 9- 6 months before your expiry.

A tourist visa or visit visa issued to a foreign applicant can be extended depending on the conditions of their visa. The worst thing a foreign national could assume is receiving a SA visa extension for a further 90 days. DHA will decide how many extra days the applicant is allowed to stay in the country and if the visa is rejected, the applicant has to exit the country before the existing visa expires.

The application for an extension must be submitted 60 days before the expiry date of the current visa and if the visa was issued for less than 30 days then no later than 7 working days from the expiry of the visa.

The application must be submitted through VFS in South Africa and the applicant must schedule a date to submit their application. On the day of their appointment, biometric details and photographs will be captured then hand in your application to the official.

ICT Visa extension

ICT visa holders whose visa expired during lockdown can now qualify for a 2-year visa. However, these applicants must satisfy the following:

  1. You need to remain employed by your current employer.
  2. Current visa conditions, status and employer remain the same.
  3. The submission is considered to be a new application and will not qualify you for permanent residency.
  4. You need to provide proof that your skills have been transferred to a SA citizen or permanent resident.
  5. Proof that the applicant services are still needed abroad from the company.

Can I apply for a visa extension after expiry?
Can a 90-day visit visa be extended?

No, you may not apply for a renewal after it has expired. This means that you would be illegal in the country and declared an undesirable person when exiting the country. You must ensure that you apply for a renewal in advance before your visa expires as set out in the regulations.

The only applicants exempt from applying for a renewal after their visas have expired are foreign nationals whose visas have expired during the lockdown. These applicants have up to the 30th of September to renew their visas or else they would be declared undesirable.

If you apply for a renewal with an expired visa, officials from VFS will refuse to accept your application.

If you are in the country with an expired visa, the best option is to leave the country and upon exit, you will receive a letter stating that you are banned from South Africa for 12 months or 5 years depending on how long you overstayed. Once you received your letter, you may appeal the decision to lift the ban.

To appeal the decision, the applicant must submit the following documents to the overstay appeals department:

  1. Written Representation
  2. A copy of the declaration of undesirability (form 19) that was issued at the port of entry.
  3. Copy of the relevant pages of the passport, including the bio page.
  4. Acknowledgement of receipt (In cases where the applicant applied for a permit and the visa is still pending)
  5. If the applicant overstayed due to medical reasons, then a medical certificate must be submitted.

Once you have all the necessary documents, then your appeal application must be emailed to overstayappeals@dha.gov.za and you can contact the IMS deportations department at 012-406 4985 to confirm if your application has been received.

How soon can I apply for a visa extension?

As mentioned earlier, you may apply for a renewal 60 days before the expiry date if you received 90 days on your current visa and 7 days if you received 30 days or less. All temporary residence applications must be submitted 60 days before the time and no late application will be accepted.

How long does a visa extension take?

Home Affairs mentions that processing times are as follows:

  1. Tourist visa – 4 weeks or less
  2. Temporary residence visa applications for business and general work visas will be finalized within 8 weeks or less.
  3. Temporary residence visa applications for critical work visa -4 weeks
  4. All other TRP applications, renewals, changes of conditions and extensions will take 60 days.

The processing times have been impacted by Covid-19 and therefore applicants can expect 3 – 5 month delays if not longer. We would advise applicants to persistently follow up with Home Affairs until they receive their outcome.

Whilst awaiting the outcome of your visa, we advise that you do not leave the country as you will be declared undesirable and banned from the country.

An extension must be applied for through VFS. The visa facilitation services act as the middle man, therefore collecting and handing over visas to the applicants. You may collect your outcome once a decision has been decided and you have been alerted. You are allowed to collect in person or a representative may collect your outcome on your behalf. You must collect your outcome where you submitted your application and you will require to present your passport as proof when collecting your visa label or refusal letter.

What documents should applicants or representatives present when they collect?

  • The same passport you used to submit your application.
  • Original invoice cum receipt
  • SAPS issued affidavit (if applicable) (Only applies if you have lost your original invoice cum receipt)
  • Valid signed power of attorney (If applicable) (If a representative is collecting on your behalf)

Applicants may collect their outcome from Monday to Friday except for public holidays between 10:00 am to 3:00 pm

Representatives must provide the following:

  • Original ID photo
  • Power of Attorney letter
  • Applicants original passport
  • Original invoice cum receipt. no photocopies allowed.

The power of attorney letter must state the following clearly:

  • Name of the person collecting on behalf of you.
  • Photo ID number of the person collecting on behalf of you.
  • Your signature signed on the invoice cum receipt and passport are the same.
